2007 | Colombia : A judge of the New York court has just accepted a complaint from Colombia against Pernod-Ricard and Diageo. The two groups are charged with organizing the smuggling of their products thanks to the laundering of the incomes of cocaine.
The trade takes part in three phases. First, the money from the sale of cocaine in the streets of Washington or Boston was deposited on the accounts of figureheads in the United States. Then, the traffickers transfered these dollars to Colombian purchasers, in exchange of pesos available on their country of origin. Enticed by a generous commission, the purchasers of the green tickets pocketed the money through shell companies in Panama or Aruba. Last, with these almost laundered funds, the offshore companies bought to the multinationals Ballantine' s whisky, Domecq brandy or Gordon's gin to smuggle them in Colombia.
Pernod and Diageo "were perfectly well-informed from what occurred", accuses Bogotá. The two companies would have "constantly controlled" the trade of laudering, and taken part directly in the creation of the "network of companies, in Panama and Aruba, intended to camouflage the criminal origin of the funds". Up to now, Pernod Ricard and Diageo tried to obtain the rejection of the complaint for legal flaw, and even to have the case judged by the Colombian justice - much slower, blocked and prone to corruption. But since the refusal of the new Yorkean judge, Pernod Ricard repeats that "the complaint is not founded". | Libération |
