A Japanese court recognized with the widow of an employee of the car manufacturer Toyota the right to perceive a pension, ruling that her husband was, literally, killed with the task. Kenichi Uchino, a 30 year old engineer, had died two hours after having broken down at its working station of the factory Toyota de Tsutsumi (center) in 2002. His wife, Hiroko Uchino, had claimed with the Japanese government a pension of widowhood to the title of the industrial accidents, asserting that the excessive overtime carried out with the factory by her husband had caused a cardiac arrhythmia, at the origin of her death. According to it, Mr. Uchino had carried out nearly 150 overtime of work during the month which had preceded its death. The court of the district of Nagoya gave reason to Mrs. Uchino. According to judges', Mr. Uchino had carried out 106 hours and 45 minutes additional, and "at his place so much it could not return any more was occupied".: Japan

ILO violation 87,98 : The Toyota Motor Philippines Corporation (TMPC) continued to ignore a Supreme Court order to recognise and enter into bargaining with the TMPC Workers' Association (TMPCWA). It also continued to refuse to reinstate workers dismissed in 2001 for taking part in peaceful protests over the company's refusal to recognise the union. The government failed to implement a recommendation by the ILO to amend its legislation to allow for " a fair, independent and speedy certification process", and to "make every effort to ensure that the TMPCWA and Toyota Motor Philippines Corporation negotiate in good faith in order to reach a collective agreement. While the TMPCWA's campaign for recognition continues, a new yellow union supported by management – the TMPCLO (Toyota Motor Philippines Labour Organisation) - was organised, and immediately filed a petition for certification election. Management's deliberate intransigence and refusal to bargain in good faith with TMPCWA has prevented an agreement for five years, opening the door to a certification challenge. DOLE officials oversaw the certification vote on 16 February, and neither TMPCWA nor TMPCLO received a majority of the votes. The TMPCWA then filed a petition with the DOLE to nullify the election -- and not surprisingly, the TMPCLO, with the support of management, opposed the petition. TMPCWA pushed forward with demands to re-start collective bargaining negotiations and seek reinstatement of the remaining 136 workers fired since 2001, but these demands were rejected outright by management. In April, DOLE rejected the TMPCWA's petition, and subsequently proceeded to certify the TMPCLO as the legal bargaining representative, despite the fact that it had not received a majority of the workers’ votes. The International Metalworkers Federation (IMF) launched a global campaign to pressure Toyota to reinstate the fired TMPCWA members. On 16 August, security guards at DOLE headquarters used violence to try and prevent TMPCWA members from entering the DOLE compound, and fired shots in the air to intimidate workers. TMPCWA members succeeded in gaining entry to the DOLE but subsequently 21 trade unionists, including TMPCWA President Ed Cubelo, were arrested by the police. The unionists were detained for three days before finally being released.: Philippines

ILO violation 87 : On 6 January, management of the carmaker Toyota Kirloskar Motor Private Ltd (89% owned by Toyota) fired three union leaders of the Toyota Kirloskar Motor Employees' Union, affiliated to the Centre for Indian Trade Unions, for alleged ‘disciplinary’ reasons. Union members at the factory in Bidadi (on the outskirts of Bangalore) countered that the factory-level leaders had in fact been terminated because of their active role in the union, and 1550 workers promptly went out on a wild-cat strike to demand reinstatement of their leaders. Management responded with a lock-out of the strikers, starting on 8 January, and suspended another 27 union members. Three separate efforts by government regulators to mediate a resolution to the impasse failed, as management repeatedly refused to meet with the union for joint talks, and insisted that all strikers sign a pledge to "maintain discipline and ensure full production" before allowing them to return to work. Finally, at the prompting of the company, the Karnataka State Labour Secretary issued an order on 21 January, prohibiting the workers’ strike from continuing. On the same day, 1300 striking workers were arrested by police for unlawful assembly as they marched to petition the State Labour Secretary. Most of the workers were released the same day. Deprived of their right to strike, union members were compelled to return to work on 24 January and to sign a modified written pledge before entering the factory. The dismissal of the three union leaders and suspensions of 27 workers were appealed by the union to the Labour Court.: India
